PROPERTY MANAGEMENT AGREEMENT IN KEROBOKAN, PADANGSAMBIAN, CANGGU, UBUD BALI

An example of a cooperation agreement entered into by I Putu Agus Putra Sumardana, SH & Partners and clients is a property management agreement in Kerobokan, Padangsambian, Canggu, Ubud Bali. The agreement arrangements include:

This agreement will be binding when it has been signed and given a date and will be for a period of up to 10 (ten) years. If one of the parties decides to terminate the agreement before the expiration date, the parties must notify each other no later than 30 (thirty) days before the date termination. The agreement cannot be terminated less than the end of the next reporting period after the current one. The reporting period is one calendar month period.

During the time this Agreement is in effect, I Putu Agus Putra Sumardana, SH & Partners shall:

  1. Manage the Property to the best of I Putu Agus Putra Sumardana, SH & Partners’s ability, devoting thereto such time and attention as may be necessary;
  2. Offer the property for rent in compliance with all applicable federal and state laws, regulations and ethical duties, including but not limited to, those prohibiting discrimination on the basis of race, color, religion, sex, national origin, handicap, familial status or sexual orientation in the leasing of the property;
  3. Listing the Property with online booking services.
  4. Collect all rentals and other charges and amounts due under tenant leases and give receipts for amounts so collected;
  5. Make the monthly report once in a month and send to the Owner by email including gross revenue and all monthly expenses before 10-th day of the month;
  6. Make or cause to be made any repairs which, in I Putu Agus Putra Sumardana, SH & Partners’s opinion, may be necessary to preserve, maintain and protect the Property; provided, I Putu Agus Putra Sumardana, SH & Partners may not make any repairs that exceed $200 (Two hundred) US without prior approval of Owner, except that in the case of an emergency, I Putu Agus Putra Sumardana, SH & Partners may, without prior approval, make whatever expenditures on behalf of Owner that are reasonably necessary to preserve the Property or prevent further damage from occurring;
  7. Answer tenant requests and complaints and perform the duties imposed upon Owner by tenant leases or any local, state or federal law or regulations, including the authority to purchase such supplies and hire such labor as may be necessary in I Putu Agus Putra Sumardana, SH & Partners’s opinion to accomplish any necessary repairs;
  8. The Agent is responsible for communications with current and future guests of the Property at the stage of booking and during their holiday, including ground handling, meeting at the airport (for extra charge or included in the staying price), check-in and check-out and organizing guests activities;
  9. Negotiate partial refunds with tenants if, in I Putu Agus Putra Sumardana, SH & Partners’s reasonable opinion, the tenant’s use and enjoyment of the Property has been or will be materially and adversely affected as a result of a defect in the condition of the Property (such as a repair to the electrical, plumbing, sanitary or ventilating facilities or a major appliance that cannot be made reasonably and promptly). hire, promote, discharge, terminate, pay the salaries and replace if necessary and supervise all the staff employed at the Property.
